Jared Fogle Will Plead Guilty to Child Pornography Charges, Sex With Minors

According to court documents released Wednesday, Subway spokesman Jared Fogle is expected to plead guilty to one count of travel to engage in illicit sexual conduct with two minors and one count of distribution and receipt of child pornography.

Fogle has reportedly agreed to pay $1.4 million in restitution to 14 minor victims, two of whom he had sex with. Fogle will also be required to register as a sex offender and undergo treatment for sexual disorders; he has agreed not to request less than five years of prison time, and the government in turn agreed not to ask for more than 12.5 years.

According to the Associated Press:

Federal prosecutors allege in the documents that the married father of two traveled to pay for sex acts, including with minors, from 2007 until as recently as June and that he repeatedly planned business trips to coincide with his sexual pursuits.

On Nov. 3, 2012, Fogle allegedly paid a 17-year-old girl who he had found online to engage in sex acts while he was staying at the Plaza Hotel in New York City, according to the papers. Several months later, he again paid her for sex acts while staying at the Ritz Carlton Hotel, according to the document, which says the girl told Fogle her age when they first met and that he knew she was a minor.

After the first meeting, the document said, Fogle texted the girl and offered to pay her a fee if she could find him another underage girl to pay for sex acts.

During these discussions, Fogle “stated that he would accept a 16-year-old girl, while stating that the younger the girl, the better,” the document said.

Fogle also reportedly received child pornography on various occasions from Russell Taylor, the former head of the Jared Foundation. The remaining 12 victims to whom Fogle will pay restitution were secretly filmed engaging in “sexually explicit conduct” by Taylor, and Fogle was found in possession of those films.

Two months before Fogle’s home was raided, Taylor was arrested on child pornography production and possession charges; at the time, Fogle released a statement condemning Taylor’s actions. Taylor attempted suicide in jail soon afterwards.

The sandwich chain said this week that it has ended its relationship with Fogle; he had represented the brand for more than 15 years after losing 200 pounds through a Subway diet.

UPDATE: An early version of this post implied that Fogle had sex with all 14 minors to whom he will pay restitution, when according to the newly-released official plea deal, 12 of those minors are being paid restitution as a result of pornography charges. The post has been updated to reflect this.

Fogle’s wife, Katie, has released a statement via her attorney:

“Obviously, I am extremely shocked and disappointed by the recent developments involving Jared. I am in the process of seeking a dissolution of the marriage. My focus is exclusively on the well-being of my children.”
