Everything's Gayer in Texas: Judge Strikes Same Sex Marriage Ban

Break out the rainbow celebration chaps: a Federal Judge has ruled that Texas’s voter-driven gay marriage ban is unconstitutional. Yee-haw!

Judge Orlando Garcia issued the injunction against Texas’ law today, citing the fact that the Constitution doesn’t guarantee bigots the right to shit all over everything, despite increasingly whiny whining to the contrary. Here’s the Washington Post with more on that.

“Without a rational relation to a legitimate governmental purpose, state-imposed inequality can find no refuge in our United States Constitution,” Garcia wrote. “These Texas laws deny plaintiffs access to the institution of marriage and its numerous rights, privileges, and responsibilities for the sole reason that Plaintiffs wish to be married to a person of the same sex.”

And Matt Pearce, a national reporter for the LATimes, found this deliciously “smackdown” bit from the ruling itself:

But same sex couples in Texas can’t head down the aisle just yet; the ban remains in place until an appeals court issues a ruling. Texas Attorney General/crazypants Gubernatorial candidate Greg Abbott is expected to file an appeal to the Fifth Circuit, which is famously whackadoodle. If they end up reinstating Texas’s ban, they’ll finally, once and for all establish the conservative wing of American politics as the “pro family” wing. Because nothing says “family values” like failing to recognize the legal status of people who have formed families.
