I have a theory that marriage should be dealt with as a contract. There are certain things in that contract that you need to do, and if you don't it should be considered a breach of contract and there should be damages attached.
People would be able to agree to what those damages would be ahead of time. They don't have to get married, but if you do, you'd have a contract. I'm just saying.

I've had the extreme displeasure of meeting Tom Prichard during my time at the Minnesota State Senate. For 3 months I had to listen to him spout his bullshit on a weekly basis against medical marijuana. He is the single most insufferable man I met during my time there, unable to see an inch past the evangelical family values bullshit that comes out of his mouth like so many "facts".

Well South Carolina too has adultery and fornication laws that make them crimes, but they are not enforced. They aren't gender specific either, so theoretically at least Mark Sanford could be charged with the crime of adultery. I wish they'd do that since they've only chosen to censure him!

I get so frustrated that old laws like they take forever to get repealed. Here in Virginia it's still illegal to partake in "lewd and lascivious cohabitation" or "fornication". And in the 80s a couple was actually charged! The state supreme court ended up throwing the conviction out because it's stupid, but why is such a law still on the record anywhere?
@theysaidwhat: the supreme court found all anti-sodomy laws to be constitutionally invalid in the early 90s. whether they're still "in the books" in some states doesn't matter, a charge of sodomy would be thrown out of court even by the most conservative of judge.
