Justice Scalia Says Abortion and Gay Sex Are Obvs Unconstitutional

Justice Antonin Scalia loves the U.S. Constitution. He loves the Constitution so much that he never wants it to change, even though it’s no longer the 1700s and therefore we’ve made some exciting social progress — banning slavery, for example! — as we mature as a nation.

Hogwash. As Scalia recently explained at the American Enterprise Institute, certain issues are a piece of cake to understand if you never widen your scope of vision to let real life in:

“The death penalty? Give me a break. It’s easy. Abortion? Absolutely easy. Nobody ever thought the Constitution prevented restrictions on abortion. Homosexual sodomy? Come on. For 200 years, it was criminal in every state.”

Scalia also said that “We can disagree with one another on the law without taking it personally,” which is certainly easy for a heterosexual male Supreme Court Justice to say.
