What everyone is missing is that labor laws are enforced by states, not cities. The Newsweek article is essentially correct when it says the city can't do anything: It's up to the Texas Workforce Commission now. (Newsweek mentions that there's a state law against dancers under age 18, but I don't know what agency enforces that.)

Unfortunately, most child labor law violations are handled by fines. I don't think any state allows a business to be shut down for just one child labor violation. The one real hope for shutting this place down is that things like chlid labor violations can be used as grounds for the city to refuse to renew the license next time it's up for renewal.

@bojgen: The Newsweek article actually says the club doesn't serve alcohol, because "bottomless clubs" can't serve alcohol in Texas. (So the real bad news there is that the 12-year old was probably dancing fully nude.) Anyway, many states allow underage employees in establishments that serve alcohol, as long as the underage employees don't serve it.

My mom lives in Richardson but on the border between Dallas and Richardson, literally. The Dallas side of her street is dry but the Richardson side sells beer and wine. So her choice of which grocery store to shop at is much easier these days. Also, inside Richardson is the town of Buckingham that was created JUST so they could sell liquor inside the city limits.

Austin is where hipsters and neo-hippies go to pat each other on the back and eat migas. I'll take the migas. You can keep the hipsters. Dallas is like Houston in that, as long as you stay south of LBJ you will probably live around laid back liberal folks who will sell you alcohol without limits. Just stay away from Plano and Frisco.

If you read the newsweek article it says that the girl "had the body" of a 20 year old. does that absolve the club owner of hiring her without proper ID (the article says she couldn't provide it) absolutely not. But it doesn't appear to be a case where they were specifically hiring a little girl to feed the fanatsies of pedophiles.

Also in the article it says that this place WAS a fully nude club. It is BYOB and the way those establishments attract their customers is with full nudity, specifically "bottomless" dancers. as dallas does not give liquor licenses to those clubs that have full nudity.

I think the club should be held responsible for being negligent in its hiring pratcices and thus unknowingly contributing to the exploitation of a minor, however lets save our ire for the man that abused her and pimped her out to this club, AND THE WOMAN who was living in the house and allowed the exploitation of the girl to occur.

Second of all, she probably wasn't naked. I'm not sure strippers can even be completely naked in Texas anyway. So, what, she was onstage as scantily-dressed as any number of twelve year old girls at the beach are every day, in public?

I'm not saying I approve of this, I'm just saying that it's possible that it's kind of a weird confluence or ordinances that allowed this to happen.

And I'm not hugely worried that it'll happen again--Texans are vehemently opposed to legal pornography and child endangerment, they're already trying to fix the gap in the laws.
