first of all, there's an error in Dodai's report. JK Rowling's publisher (Scholastic in the US, Bloomsbury in the UK) and Warner Brothers are fighting the so-called "encyclopedia". The people saying her copywrite doesn't cover her own damn work is the publisher of the "encyclopedia" aka RDR Books.

The "writer" of the encylopedia has run an online reference site for years. He decided it would be a Really Good Idea (aka he can make money!!!) to publish portions of the Lexicon as a book. When Warner Brothers et al asked to see the book to verify if it encroached on Jo's copywrite, they were told to "print out the website". Niiiiiiice. RDR has said at one time it was a collection of essays - but they never got permission from the on line essayists to print their essays. Then they said it's just a reference book - basically regurgiating Jo Rowling's original work but in a different format. If there's no original work, then it's not fair use, it's blatent copywrite infringment.

Jo has publically stated she intends to write her own reference book, as is her right.

The ramifications for fandom are HUGE. SVA (the author) claims that by virtue of Jo Rowling knowing aobut his website means he has the right to publish - for profit - a complilation of her work (remember, there's no original critical analysis of the books). If he wins this suit, all creators will be *forced* to crack down on fan sites, fanfiction, anything related to their show/book/movie. As it stands now, most creators turn a blind eye, knowing that fannish works simply promote their product to other interested people (it's how I got pimped into Battlestar Galactica, for example).

Long-ass answer, sorry. But this is a BFD- and it is NOT a First Amendment issue. Jo holds the rights to her work and no wanna-be "writer" has the right to take her work and make a profit on it.

I get that she's planning on publishing her own Potter encyclopedia, but compiling and index of someone else's published work is no more illegal than writing a book review. I give her huge props for way she's kept control over her books and their marketing, I remember when the first few came out... they were becoming hugely popular and it was refreshing not to Harry Potter branded lunchables. It's also telling that she's seems to really get things like fan-fiction, but when it comes to activities that might actually make a buck she calls out the lawyers. Oh, and did I mention that I'm a librarian, and therefore actually fascinated by intellectual property issues?

It may have seemed tacky and mean, but it was anything but. It was trying to show people that reading gossip magazines and reading Perez Hilton is what is tacky and mean. We, as a society, really want a sacrifice for the next harvest. And from the looks of things, Miley Cyrus really is the next lamb to be led to the slaughter.
