There may be local laws that make taking "upskirt" photos illegal, but they are likely to fall into a harassment category - not assault.
Saying "I'm going to rape you," and having the means (a weapon & proximity - hands would do) and inclination (hostile appearance) to carry out the threat, in most parts of the US would absolutely constitute assault. Once a person has said this, and laid a hand on you, it becomes assault & battery. Think of assault as a threat, and battery as any action that could further the completion of that threat.
So - the takeaway message would be this:
Consider what a cop, witness, or jury would think if they heard your testimony.
If a guy is 20 feet away, shooting pictures from the bottom of an escalator w/ a telephoto lens, and you go down to "deck" him, you might be the one who gets an assault (and battery) charge.
On the other hand, if a person is close enough to touch you, and makes a threatening movement that invades your personal space - what if it's not a silver camera phone, but a knife? - then you are much more likely to meet with sympathy if you use means at your immediate disposal to defend yourself.
Take a self-defense class! Own your personal space, wherever you go - be aware and act to deal with a threat instead of being forced to re-act. If you carry a formal weapon (knife / gun / Taser /pepper spray, etc.) - make sure you know what the practical and legal implications are for you if you use it on, or even display it to an attacker.
Don't take any shit, Jezzies, but don't let some asshole get you arrested, either. If enough cameras are broken, gropes answered with bloodied noses, pervs' pictures posted to public websites, it will become a LOT less attractive to them.

I did realize today that the escalator at my office has a reflective panel on the side of it, and when you stand close to the edge of the step, the reflection shows right up your dress, should you be wearing one.

What I need to cheer me up: up-skirting was mentioned on Jezebel recently, and someone posted to say that they'd seen a gang of girls beat the crap out of one of these pervs on a tube in London. I would love to hear that story again.

My boyfriend and I fought over it few nights ago -- he was laughing at an "If Everyone Had Superpowers" cartoon that showed a man with extendable arms holding a mirror between a beautiful woman's legs. When I told him I didn't think it was funny, he told me to have a sense of humor. I couldn't believe that I had to explain to this otherwise intelligent and sensitive man that a stranger had told me in the most resounding manner possible that my body was not mine, and that this cartoon was validating his desire to violate me.
