This is sad but not surprising. I wish I was a better person, but I'm not. The first thing that popped in my head was 'are black people going to be blamed again'? I don't know if the racist backlash that took place after the election had anything to do with this decision but I think it's time that everybody took a step back, regrouped and start over. As many people have said above, how was it that the government was brought into such a private and personal thing as marriage. Former Prime Minister Pierre Trudeau once said that the government has no place in the bedrooms of its citizens. This is a civil rights issue, not a 'lifestyle' issue.

I went to the Reject Prop 8/Decline to Sign Ref. 71 rally in Seattle yesterday, and I think it was the first time I've gone to a demonstration and NOT had crazies screaming at me from across the street.

We are winning, slowly. Washington Jezebels, while the governor just signed the domestic partnerships law, a group is trying to get Referendum 71 on the ballot to repeal it. If someone comes up to you asking for your signature "to protect Washington families" or some shit, DON'T SIGN IT. Paid signature-gatherers are not legally required to tell you the truth about what you're signing. The DPL opponents need 120K signatures by July 12, make sure it doesn't happen! Tell your family and friends!

I can't imagine what it would be like to be one of the couples that is allowed to stay married. On one hand, you get to keep your marriage, but on the other, surely some of your good friends didn't think to or want to get married and now you're separated by a gaping social divide.

Dammit, California. There are just some things that should NEVER be legislated on. Yes, I understand this is a democracy and yada yada, but when it involves someone's basic civil rights, the majority should not get to decide that it wants to take away such rights. If we had a popular vote on interracial marriage, it would be struck down in many states. I'm (probably, from the looks of it) going to marry outside my race, and I see no difference between me marrying outside my race and me wanting to marry another woman, but one's legal (based on a SCOTUS decision, not a popular vote) and the other isn't (based on a popular vote). Both race and sex are arbitrary, biological traits that can't be changed. I wish the SCOTUS could do like a sort of follow up to Loving v. Virginia and strike down anti-gay marriage laws. I don't give a fuck if it offends you personally that some guys want to marry other guys and some women want to marry other women...keep your nose out of other people's bedrooms!

@victoriasauce: Or protesting those chapels in vegas where you can get married in your car. If you're allowed to get married the same way you order a Big Mac, marriage sort of loses it's 'sacred' feel, doesn't it?

This is such a heartbreaking picture. I worked in CT with Love Makes A Family, and as someone who identifies as hetero, it's truly striking to realize how basic a right legal recognition of love really is, and one that so many take for granted.

Let's hope it gets back on the ballot for 2010, because unfortunately regarding legality, the judiciary cannot overturn that idiotic vote. Bottom line is, no one has any right to tell someone else they cannot marry the person they love. C'mon, CA!

@AtomiClash: The only reason the same Supreme Court that legalized it in the first place, upheld Prop 8 was because they didn't want to go against voters. If CA-ers can get another initiative on the ballot to overturn it, I think the court would side with them again.

And it's beyond ludicrous that we allowed the majority to vote on an initiative that would only affect a minority. CA voters should never have had that right in the first place.

The only sigh of relief I got yesterday was knowing that my mom's friend Liz's brother is still legally married. Apparently his first marriage in San Fran was revoked and then he was going to marrying in a civil union until the Supreme Court legalized marriage temporarily. Thank god he gets to stay married.

@EkaterinaBallerina: I'm confused about this. If gay marriage is illegal, then how are these coulples' marriages still legally recognized? Is it them saying "it was a big mistake to legalize it even briefly, but these 18,000 couples will benefit from said mistake"?

@PrarieMuffin: Near as I can understand it, the California Supreme Court ruled last year that gay marriage was legal. After Prop 8 passed, it was no longer legal. If a couple got hitched in the interim period when it was legal, their marriages were legit.

It's like a marital Blue Light Special at Kmart, or something.

@la.donna.pietra: Exactly. The initial Court ruling was that gay marriage was legal under the California Consitution. Prop 8 amended the Constitution. So, those people who were married under the pre-amendment version of the Constitution were married legally. Because the Constitution now explicitly prohibits gay marriage, no new marriages can be performed. Prop 8 apparently did not explicitly contain language invalidating marriages performed prior to its passage and so those marriages are still valid.

This is so awful. I realize we're moving in the right direction and no massive change is going to happen overnight, but I want my children to grow up in a world where who they marry is only a question of the right emotional and physical fit, not of state-approved gender roles.

(That said, I had a conversation about gay marriage with my mother last night and actually got her to admit that she doesn't support equal rights for all citizens of legal age. After this she was quiet for a while and said she needed to get back to me later once she'd had time to think.)
