    I am currently drinking Barefoot Chard., watching Wyatt Earp with Kevin Costner cause it is one of my favorite movies ever. Seriously, I'm naming my son Wyatt.


    Kevin Costner's music career does not dampen my love of this movie.

    @ceejeemcbeegee: Yeah, I mean, he was injured. Something caused it, whether it was pilot error or something with the plane. I do products-liability defense and so am generally skeptical of lawsuits with BS injuries, but hello, in addition to physical injuries, I'm sure he has really suffered mentally.

    @Maritsa: Ha - I do products defense too! I have that bias. But appears as though some one f'd up here - it will come out in the wash whether it was mechanical or human error. I'm probably a little too interested in this case for my own good. (I am defending three bullshit claims right now and one other that makes me cry).

    @WaltzingMatilda(theOriginal): I live for the BS claims because I have no guilt when I defend them. Like one I have now which is going to eat my life for the next few months (ugh).


    The worst are the ones where the person is definitely injured and you know they're not going to be able to prove causation and will thus end up with not much of a settlement. I had a case like that once - broke my heart. It also broke my heart when a paralegal I liked said "What goes around comes around" because the victim had broken up a marriage. Uh, yeah. Granted that wasn't a nice thing to do but I don't think she deserved to be a vegetable for the rest of her life because of it.

    Erm... why is it no OK for them to get compensation from the insurance companies after that horrible accident? I mean, if you were in a major airline crash, the airline would give a pay out, right? School me.

    @ceejeemcbeegee: Yes, the airline would pay out, but I don't know if the commercial pilots' insurance would pay out. (Depends on if they were sued, for starters).
    I definitely have a bias as a defense attorney here. I would love to see the insurance policies to see if they covered the pilots' negligence/gross negligence/recklessness. I would assume that it covered mere negligence, so basically dude still needs to prove that the pilots fucked up - which may be what burns people's britches, since they are dead.
