Regarding the SCOTUS ruling: I have worked in the legal profession for many years, and my least favorite saying that I have unfortunately heard way too many times is "I didn't say it was right, I said it was just." Some things about our legal system really, really make me sad.

@sportz.star: While that's a fine point, you're not exactly right. Due process, including procedural due process, is basically what DNA evidence might fall under. Particularly since the technology either wasn't there or up to snuff. The Court punted. Which is fine. But pretending the constitution doesn't actually do much isn't great, either.

@sportz.star: I agree with Sportz actually. Just because I can think of a basis to allow DNA testing doesn't mean that I believe it provides a strong enough basis to define it as a constitutional right. I think SCOTUS did right here by making the federal floor low and leaving room for the states to implement the procedures.

@Trulymadlyme: I agree that procedural due process would be would it would fall under if construed as a constitutional right.

@Zombies make the heart grow fonder: Maybe as DNA testing becomes easier to do (I'm assuming the technology will just get better and better), it will become more of a "due process" thing. Since it's been so expensive and time-consuming in the past, it's often been hard for some places to pay for it. Maybe that consideration will go away in time.

Just a general comment and hopefulness. :)

@HarpMadness: It requires more resources, for sure. Consider that many places can barely process rape kits, I'm guessing that is why DNA evidence is oftentimes difficult to get and/or process. That doesn't mean a person doesn't have a right to such evidence, though. It means that if the government intends on taking away someone's liberty, they should be prepared to expend the necessary resources to prove up their case and to allow a defendant to defend themselves. It was a bad decision.

@Zombies make the heart grow fonder: Just getting back to this thread . . . I think there are a lot of good points here and I'm in favor of process, but even as a liberal, I'm not in favor of reading more and more process as being procedurally due to all people.

@bluebears: I think, as clearly demonstrated in the dissent, there are arguments for a prisoner having a DNA test, but I also think that this should be a matter of legislation and not constitutional requirement because it essentially would state that there's a constitutional right to use extra-judicial means to introduce new evidence, that existed at all times during the conviction process (though I understand we're talking about old cases here, maybe the technology didn't) in order to change the outcome. It's not really "new evidence" so I don't think it's constitutional. I have zero problem with the laws that give prisoners the right to the DNA test, however. I just think there's a line there.
