The complaint is one of the most hilarious legal documents I've ever read (the "as a matter of law, the house is haunted" opinion is still my fave).

Here are some highlights:

13. According to the Book, a Douchebag is, inter alia, "a feminine hygiene device used for cleansing."

18. The Publication refers to the Plaintiff as a Douchebag.

22. The Publication is false as it pertain [sic] to the Plaintiff.

25. Plaintiff has been, and continues to be the subject of ridicule in that he has been, is now, and continues to be called a Douchebag by friends, acquaintances, coworkers, employers, and strangers alike.

30. The Publication depicts Plaintiff has [sic] a "Douchebag" and a dubious man.

@I'm Chuck Bass: That is an amazing complaint. If they are using the definition of douchebag as you cited, can they really then argue that it is calling him a dubious man? Doesn't it, to be in any way a decent complaint have some sort of coherence. And, he's a club promoter, in all probability he is a man of dubious character... What kind of lawyer agrees to take on this lawsuit?

@saltine: I'm a dork, so I just googled the attorney/law firm. Unfortunately, their website is under construction and there's not much there. It looks like they do mostly real estate law. Huh.

I think an actual douchebag should sue them for alleging that a feminine hygiene device used for cleansing is considered derogatory, offensive, and dubious.

And, yes, there is a very big difference. This a book making fun of some dudes. GGW videotapes intoxicated girls (some underage) taking off their clothes in the shower. VERY big difference.

@killmyunicorn: Ok, we were talking about this last time. Tabloids constantly post pictures of celebrities and insult them and/or their various body parts. Yet, for the most part, these tabloids do not get sued.

Would this book be sort of the same thing. If someone is out in public they are fair game. I could put a picture of them online and make fun of it.

I know that DB1 is profiting from this book,but don't tabloids profit from what they print? Doesn't this very website post pictures of people that we then make fun of? And doesn't this website profit from such photos?

@Vivelafat says Vive La Obama: from what I remember about defamation law, celebrities and others "in the public eye" are in a different legal category because they have less of an expectation of privacy.

My super smart law school friend explained it to me once; someone had written a pretty mean opinion article about him in our school's newspaper and apparently he was fair game because he was the Student Trustee and therefore an elected official. But if he had been one of us "common folk" I think he could've sued.

@cwistomoweina: Correct. You can write "the Mayor is a crook" and get away with it because she is in the public eye. If you write "La Chica is a crook," you better have some damn proof or I am going to sue you for libel. (And the defendant must prove their accusation.)

I'm not sure how this applies to pictures taken in public places of people who are not "in the public eye." I believe it depends mostly on state law.

Either way, if I'm on the jury in this defamation suit, I'm leaning towards this dude being a flaming douche bag, because friends and co-workers are only going to take teasing so far. They will eventually say, "Dude, I AM KIDDING" and then whisper "douche bag" and laugh. Whatever. He either can't take a joke, or those who know him best aren't joking.
