Having laws on the books that aren't USED diminishes the importance of REAL laws, darnit.

I'm sure Scalia et al would argue this isn't "private" conduct because the state is involved in that it solemnized the marriage, other parties are involved, yadda yadda. But there's no way a conviction would withstand a constitutional challenge after Lawrence.

Marriage was originally created when God made Eve as Adam's partner, taking his rib and crafting her especially for him. From now on, true marriage should be only between a man and his surgically removed rib.
What about consensually open marriages? Does the law take into account that some married individuals may be willing to be "cheated on?" Maybe for the fine to apply, one of the partners has to be the one to file the complaint?
I could see this quickly turning ugly if false accusations of faithlessness on the part of your partner would result in a hefty fine. What a way to avenge a marital grudge.
I'd think there would have to be some sort of trial to determine the accusations. Which would make for a fun Exhibit A. Confiscated sexting missives! Grainy Polaroids!
