@bluebears: I think, as clearly demonstrated in the dissent, there are arguments for a prisoner having a DNA test, but I also think that this should be a matter of legislation and not constitutional requirement because it essentially would state that there's a constitutional right to use extra-judicial means to introduce new evidence, that existed at all times during the conviction process (though I understand we're talking about old cases here, maybe the technology didn't) in order to change the outcome. It's not really "new evidence" so I don't think it's constitutional. I have zero problem with the laws that give prisoners the right to the DNA test, however. I just think there's a line there.

Sometimes, a statement is so asinine, that I cannot even formulate a response. The best I can do is shrug, and hope that he can't cause any damage from falling off his soapbox.
