In news that will most likely desiccate the last little puddle of faith you have in human rationality, some enthusiastically religious parents in Queens are asking a judge to nullify a law that would keep their children out of school if classmates are carrying communicable diseases such as measles, mumps, and chicken pox (which, to my daily mounting terror, I've never contracted). Lawsuits filed last week in Queens Supreme Court by parents Fabian Mendoza-Vaca and Nicole Phillips have been transferred to Brooklyn Federal Court and could be resolved as early as next week in an emergency hearing where some secular-minded necromancer will hopefully raise Clarence Darrow from his grave so he can give everyone involved a proper finger-wagging. Jimmy Fallon has been widely recognized as one of the nicest guys in the late night business, but that hasn't stopped him from being sued for punitive damages and lost wages by former employee Paul Tarascio. Tarascio claims Fallon had him fired and replaced by a "totally incompetent woman." Tarascio accuses Fallon of a "gender bias" that has allegedly cost several men their jobs. According to the documents filed by Tarascio, Late Night's director David Diomedi told him that "Jimmy just prefers to take direction from a woman," then Diomedi "knowingly fabricated alleged performance issues" against Tarascio in order to have him terminated. Macy's is suing Martha Stewart Living Omnimedia for breach of contract, following the announcement that the Martha Stewart brand of homewares would be sold exclusively at J.C. Penney following the expiration of her current exclusive Macy's contract. The Macy's deal was set to expire this year, freeing Martha to shill muffin tins and bath mats at Penney's starting in 2013, but Macy's claims its contract allows them the option to renew for another five years. Macy's sure seems sad it lost its shiny toy, but we're team Martha on this one. Stewart may be 70, but we're in no doubt she could still cut a bitch. Alisa Speller says that after paying Toys R Us an extra $15 dollars to have employees assemble the Radio Flyer Pathfinder Wagon she bought for her 1-year-old daughter Skyla Price, the wheel popped off the first time they used it. Speller says that while pushing Skyla across a street in the Bronx, "I just flipped over it and fell on top of my daughter." While most people would take out their frustration on the poor soul working at the store's customer service desk, Speller is suing the company, saying "If they charge people to assemble it, they should do it correctly." Speller may have trouble proving her case, since the instructions state that adults should "periodically check hardware and tighten if necessary," and note that the toy should never be used, "near motor vehicles, streets, roadways, alleys, swimming pool areas, steps, sloped driveways, inclines, and public highways." When you first heard that Pixar is releasing a film called Brave you were probably surprised to learn that it's about a feisty Scottish girl, not one of the Atlanta Braves. Now it's emerged that the Atlanta National League Baseball Club, which owns the team, has been working for months to save other moviegoers from facing the same confusion. Though the team doesn't have a trademark on the singular word "brave," it's objecting to Pixar using the title because fans often use the term when referring to a single player. Shame on Pixar for trying to trick people into watching a kids movie with a female protagonist by suggesting it's about the adventures of a baseball player on team with a problematic name. More »

Bridgett Nickerson Boyd claims in a lawsuit filed last week that last year in Texas, sheriff's deputy Mark Goad arrested her for driving on the shoulder when she pulled off the highway because her engine was steaming. Then her heart started racing, so Goad followed her to the hospital, and arrested her after she had been treated. That still wasn't the worst of it: Boyd claims that while Goad was driving her to jail, he cranked up Rush Limbaugh, who was making, "derogatory comments about black people." The charges against her were almost immediately dismissed, and now Boyd is suing for defamation, false imprisonment, malicious prosecution, assault and battery and intentional infliction of emotional distress. Perhaps she should look into class-action status for anyone who's been unwillingly subjected to Rush's blathering. More »
