			<title><![CDATA[MySpace Suicide Legal Battle Comes To A Close]]></title>

			<title><![CDATA[Is Legislation The Way To Stop Cyberbullying?]]></title>
			<description><![CDATA[
<p><img src="http://cache.gawker.com/assets/images/jezebel/2009/10/meiers.jpg" class="left image340" width="340" />The first <a href="http://www.wired.com/threatlevel/2009/09/cyberbullyingbill/">federal cyberbullying law</a>, the <a class="autolink" title="Click here to read more posts tagged MEGAN MEIER CYBERBULLYING PREVENTION ACT" href="http://jezebel.com/tag/megan-meier-cyberbullying-prevention-act/">Megan Meier Cyberbullying Prevention Act</a>, has made it to a House committee. But critics say the law would let prosecutors "harass the harasser," and the law raises the question: can laws really stop bullying?</p>

<p>The <a class="autolink" title="Click here to read more posts tagged MEGAN MEIER" href="http://jezebel.com/tag/megan-meier/">Megan Meier</a> Act <a href="http://thomas.loc.gov/cgi-bin/query/z?c111:H.R.1966:">states</a> that "electronic communications provide anonymity to the perpetrator and the potential for widespread public distribution, potentially making them severely dangerous and cruel to youth," and that "cyberbullying can cause psychological harm, including depression; negatively impact academic performance, safety, and the well-being of children in school; force children to change schools; and in some cases lead to extreme violent behavior, including murder and suicide." But its real meat is the following:</p>
<blockquote>
<p>Whoever transmits in interstate or foreign commerce any communication, with the intent to coerce, intimidate, harass, or cause substantial emotional distress to a person, using electronic means to support severe, repeated, and hostile behavior, shall be fined under this title or imprisoned not more than two years, or both.</p>
</blockquote>
<p>Part of the No Child Left Behind Act does require schools to <a href="http://www.olweus.org/public/bullying_laws.page">institute anti-bullying efforts</a>, but no federal law currently prohibits cyberbullying. The Megan Meier Act would change that. Rep. Linda Sanchez (D-CA) argues that the law is necessary because, "Bullying has gone electronic. This literally means kids can be bullies at any hour of the day or the night, or even in the victims' own home." British <a href="http://www.dailymail.co.uk/femail/article-1217289/Facebook-bullies-ruined-life-As-internet-bully-sent-jail-story-terrify-parent.html?ITO=1490">bullying victim Emily Moor</a> agrees. Of her harassment from the ages of 13 to 18, she says, "Bullying usually ends when you leave school, but with Facebook it feels as if there is no end." Her mother adds,</p>
<blockquote>
<p>The internet is a sinister, silent enemy: you simply don't know where to start to tackle the problem. But faceless as a computer may be, it is every bit as threatening as a physical bully, if not more so because the audience reading these horrible messages can be enormous.</p>
</blockquote>
<p>The <em>Daily Mail</em> is calling Moor's tormentor "the first Internet bully sent to jail" in Britain, but she also physically assaulted Moor, and it's likely she would go to jail in the US too, cyberbullying laws or no. And many in the House feel that specific laws preventing online harassment give prosecutors too much power. Rep. Louie Gohmert (R-TX) <a href="http://www.wired.com/threatlevel/2009/09/cyberbullyingbill/">says</a> the Megan Meier Act "appears to be another chapter of over criminalization," and that it could be used to prosecute the "mean-spirited liberals" who criticize him on blogs. He added that prosecutors might use the law to "harass the harasser," and that, "a good prosecutor could indict a ham sandwich."</p>
<p>While harassment by <a href="http://www.youtube.com/watch?v=iiAHm8AhbZE">a sandwich</a> is something I'd like to see, it is true that the Internet is still relatively uncharted legal territory, and laws regarding it can be misused. Megan Meier's harasser Lori Drew was initially convicted of violating the MySpace terms of service, but a judge overturned her conviction because it would allow anyone who violated a website's service terms to be prosecuted. As heinous as Drew's behavior was, such a precedent might give websites enormous powers to get users thrown behind bars for crimes much less serious than hers.</p>
<p>Then there's the question of whether legislation is even the right way to combat bullying. <a href="http://www.cbsnews.com/stories/2008/12/22/national/main4680952.shtml?source=RSSattr=HOME_4680952">Forty-five states</a> now have some sort of anti-cyberbullying law, but harassment researcher Catherine Hill <a href="http://www.miller-mccune.com/culture_society/preventing-cyberbullying-terra-incognita-1106">says</a> there's no indication yet that they actually prevent bullying. And Justin W. Patchin, coauthor of <em>Bullying Beyond the Schoolyard: Preventing and Responding to Cyberbullying</em>, <a href="http://www.miller-mccune.com/culture_society/preventing-cyberbullying-terra-incognita-1106">says</a>,</p>
<blockquote>
<p>I really don't want to criminalize this behavior. I think there is a role for both the federal and state governments in terms of educating local school districts about what cyber-bullying is and what they can do about it, and providing resources to help them prevent and respond to online aggression. But criminalization doesn't seem to me to be the best approach.</p>
</blockquote>
<p>Whenever a child is bullied, especially when the bullying has dire consequences as in the case of Megan Meier (pictured, with her mom), it's natural to ask why the authorities in the child's life didn't offer protection. And schools shouldn't throw up their hands and dismiss bullying as a fact of life, as Moor's school initially did. Criminally prosecuting bullying after the fact may have a place in any anti-bullying campaign, especially inasmuch as acknowledges that virtual harassment can cause real harm. But the often anonymous nature of cyberbullying will always make it difficult to prosecute all offenders, and the danger of over-prosecution is (despite Gohmert's flippancy) a real one. Just as <a href="http://judson.blogs.nytimes.com/2009/09/15/cracking-the-spine-of-libel/">British libel laws</a> can leave some journalists afraid to criticize anyone, cyberbullying laws could unfairly target bloggers. It might be more effective to prevent cyberbullying at the source, by teaching kids better methods of conflict resolution. Patchin himself, however, <a href="http://www.miller-mccune.com/culture_society/preventing-cyberbullying-terra-incognita-1106">admits</a> that we're still not sure how to do this. Cyberbullying may be new, but bullying itself is one of the many ancient human evils we don't really know how to curtail. At least Megan Meier's case has made us aware that we need to.</p>

			<title><![CDATA[Lori Drew Sentencing Postponed; Judge Considers Case Dismissal]]></title>

<p><img src="http://cache.gawker.com/assets/images/39/2009/05/340x_custom_1242738756836_AP090518024477.jpg" class="left image340" width="340" />Yesterday afternoon, a federal judge postponed the sentencing of MySpace predator <a class="autolink" title="Click here to read more posts tagged LORI DREW" href="http://jezebel.com/tag/lori-drew/">Lori Drew</a> to July 2nd, saying he needs more time to decide if the Missouri mom's cyberbullying conviction should be overturned.</p>

<p>Drew, 50, was supposed to be sentenced yesterday after being <a href="http://jezebel.com/5099378/breaking">convicted in November</a> of three misdemeanor charges for unauthorized computer access. She faces a maximum sentence of three years in prison and a $300,000 fine, but probation authorities recently recommended <a href="http://jezebel.com/5239481/crime--punishment">probation and a $5,000 fine</a>.</p>
<p>After authorities in Drew's home state of Missouri declined to charge her in connection to 13-year-old <a class="autolink" title="Click here to read more posts tagged MEGAN MEIER" href="http://jezebel.com/tag/megan-meier/">Megan Meier</a>'s suicide, prosecutors in Los Angeles, where MySpace is based, charged Drew using the Computer Fraud and Abuse Act, a federal anti-hacking statute. The prosecution argued that Drew's violation of MySpace's terms of service when she created a fake profile to harass Meier was the legal equivalent of computer hacking, but U.S. District Judge <a class="autolink" title="Click here to read more posts tagged GEORGE WU" href="http://jezebel.com/tag/george-wu/">George Wu</a> said the prosecution's argument was "troublesome," <a href="http://www.latimes.com/news/local/la-me-myspace19-2009may19,0,6394911.story?track=rss">according to</a> the <em>Los Angeles Times</em>. "Using this particular statute in this particular situation is so weird," said Wu.</p>
<p>In an hour long discussion yesterday, Wu questioned Assistant U.S. Attorney Mark Krause on the law used to prosecute Drew, <a href="http://www.wired.com/threatlevel/2009/05/drew_sentenced/">reports</a> <em>Wired</em>. "Is a misdemeanor committed by the conduct which is done every single day by millions and millions of people?" asked Wu, "If these people do read [the "terms of service"] and still say they're 40 when they are 45, is that a misdemeanor?"</p>
<p>Krause responded that Drew committed a crime by signing up for the fake MySpace account with the intent to harm Meier, and that she knew her actions were illegal because she deleted the account shortly after the girl's suicide. After the <a href="http://jezebel.com/5100764/myspace-trial-jurors-wanted-a-harsher-sentence-for-lori-drew">jury verdict</a> in November, the defense sought a directed acquittal on grounds that the defense did not prove their case. Judges usually quickly overrule such motions, but Wu has delayed his ruling for more than five months. Now he has further postponed the sentencing because he wants to reconsider Drew's punishment and the defense motion to dismiss the entire case.</p>
<p>Megan Meier's parents both spoke at the hearing. Wu did not look at Ron Meier during the first part of his statement, and only turned to him when his voice broke as he said, "I am no longer married to Megan's mom... We are both financially ruined, and I have gone through a living hell."</p>

Ms. Meier, who has been <a href="http://jezebel.com/5100312/megan-meiers-mother-talks-to-today-about-myspace-verdict">campaigning against cyberbullying</a> across the country since her daughter's death, closed her statement by saying, "This is not just about Megan Meier," and that Lori Drew needs to be punished in order to "make a stand now for all the people who go through this."</p>

			<title><![CDATA[E-Venge Exploits Megan Meier Suicide]]></title>
			<description><![CDATA[<p><img src="http://cache.gawker.com/assets/images/jezebel/2009/02/medium_megan120307.jpg" width="140" height="90" />In a shockingly tasteless move, an independent production company, Rocklin Entertainment, has announced an upcoming film based on the <a class="autolink" title="Click here to read more posts tagged MEGAN MEIER" title="Click here to read more posts tagged MEGAN MEIER" href="http://jezebel.com/tag/megan-meier/">Megan Meier</a> case. It is titled <em>E-Venge</em>.</p>
<p>The film, "inspired by recent events" will center around a grieving mother who "retaliates against those she feels were responsible for her daughter's death." So, not only is this movie a tasteless exploitation of the Meier family's tragedy, but it also entirely rewrites events vigilante-style! However, this is not the first time the Megan Meier case has "inspired" entertainment: an episode of <em><a class="autolink" title="Click here to read more posts tagged LAW & ORDER: SVU" title="Click here to read more posts tagged LAW & ORDER: SVU" href="http://jezebel.com/tag/law-%26-order%7c-svu/">Law & Order: SVU</a></em> titled <a href="http://en.wikipedia.org/wiki/Law_&_Order:_Special_Victims_Unit_(season_10)">"Babes" </a>featured a story line obviously ripped from the headlines of the MySpace Suicide case.  There is no release date set yet for <em>E-Venge</em>. 			<title><![CDATA[Defense Wants Lori Drew Verdict Dumped]]></title>

<p><img src="http://cache.gawker.com/assets/images/39/2009/01/thumb160x_drew_and_daughter_660_2.jpg" class="left image158" width="158" /><a href="http://blog.wired.com/27bstroke6/2009/01/lori-drew-heari.html">Lori Drew returns to court today</a> for a hearing that will determine whether or not the guilty verdict will stand.</p>

<p>As previously mentioned, Drew was found guilty of computer fraud, but the conspiracy charges brought against her <a href="http://jezebel.com/5122106/no-felony-for-lori-drew">were dropped</a>. Today Judge George Wu will hear arguments to set aside the verdicts against <a class="autolink" rel="nofollow" title="Click here to read more posts tagged LORI DREW" href="http://jezebel.com/tag/lori-drew/">Lori Drew</a>. In his dismissal motion, <a href="http://hosted.ap.org/dynamic/stories/I/INTERNET_SUICIDE?SITE=VTBRA&SECTION=HOME&TEMPLATE=DEFAULT">defense attorney Dean Steward</a> wrote: “Put simply, the question is this: Is it a federal crime to violate a Web site term of service? The correct answer should be a resounding no.” Drew currently faces up to three years in prision and a $300,000 fine. 			<title><![CDATA[Cyberbullying: Criminal Or Merely Cruel?]]></title>
			<description><![CDATA[
<p><img src="http://cache.gawker.com/assets/images/39/2008/12/thumb160x_meier122208.jpg" class="left image158" width="158" />Nicole Williams is one of the first people to be accused of harassment after a new Missouri anti-cyberbullying law was created after the death of Megan Meier. But should cyberbullying be prosecuted this way?</p>

<p>Authorities say that 21-year-old Williams sent a lewd text message to a 17-year-old girl whom she had heard was involved with her boyfriend. The specifics of the text message were not released, but some voicemails that Williams and others had left the girl threatened rape.</p>
<p>Williams' lawyer, Michael Kielty, <a href="http://www.cbsnews.com/stories/2008/12/22/national/main4680952.shtml?source=RSSattr=HOME_4680952">claims</a> that the new law which his client is accused under is poorly written and makes something illegal which wouldn't be under other circumstances:</p>
<blockquote>
<p>Kielty said Missouri's revised harassment measures are bad law. "It's probably one of the worst written laws I've seen in my career," he said.</p>
<p>He said kids used to say things face to face or pass notes in school commenting on someone's looks or weight. The new law "criminalizes behavior that otherwise wouldn't be illegal except for the medium," he said.</p>
<p>"It's not criminal. It might be mean-spirited, but it's not criminal," he said.</p>

<p>One of the problems with Kielty's arguments is that Williams' behavior would in fact be considered criminal in another medium. The prosecutor of the Williams case notes that telephone harassment (which is essentially what Williams did) has been a crime for years in Missouri.</p>
<p>Kielty argues that because dumb kids say dumb things to each other about their looks or weight (he carefully avoids talking about threatening sexual violence) that Williams' harassment should not be seen as illegal.</p>
<p>Anyone who has been in high school in the past 15 years knows that harassment akin to the Meier's and William's cases are common. Kids do dumb things on the internet all the time, but now the dramatic influence of bullying and girl-on-girl crime are getting national attention. Are we&mdash;as <a href="http://blog.wired.com/27bstroke6/2008/12/seven-people-ch.html">some of the commenters</a> on the <i>Wired</i> blog fear&mdash;turning into a coddling nanny state by expecting laws to save us from any uncomfortable moment? Or would ignoring these cases of bullying just make it okay for people to make threats of sexual and non-sexual violence just because they did it over a text message or a Myspace bulletin and not to the victim's face?</p>

			<title><![CDATA[MySpace Trial: Jurors Wanted A Harsher Sentence For Lori Drew]]></title>

<p><img src="http://cache.gawker.com/assets/images/39/2008/12/thumb160x_loridrew12208.jpg" class="left image158" width="158" />25-year old Valentina Kunasz, thejJury forewoman in the recently-wrapped Lori Drew trial, says she can't <a href="http://blog.wired.com/27bstroke6/2008/12/jurors-wanted-t.html">stop thinking</a> about Megan Meier. "I still have dreams about the testimony," Kunasz admits, according to <em>Wired</em>. Because of her emotional reaction, Kunasz says that she and the other jurors wanted to convict Drew of felony charges rather than misdemeanors. "Trust me; I was so for this woman going away for twenty years. However, on the harsher felony charge, it was very hard to find her guilty on the specific (evidence that was) given to us."</p>

<p>The passionate response of the jury has not been felt by legal experts, many of whom believe the <a href="http://blog.wired.com/27bstroke6/2008/12/can-lori-drew-v.html">decision against Drew</a> sets a dangerous precedent. According to Groklaw's Pamela Jones (via <em>Wired</em>), because Drew was convicted of violating the oft-ignored terms of service, "I don't think it's overstating it a bit to say that unless this case is overturned, it is time to get off the internet completely, because it will have become too risky to use a computer. At a minimum, I'd feel I'd need to avoid signing up for membership at any website, particularly MySpace." Some federal law experts expect the ruling in the case to be overturned when it comes up in the 9th Circuit Court of Appeals, since they believe the interpretation of the law is a stretch.</p>
<p>But apparently the jurors for the case were not upset by the new interpretation of the decades-old Computer Fraud and Abuse Act to include violations of terms of service. "The thing that really bothered me was that (Drew's) attorney kept claiming that nobody reads the terms of service," Kunasz tells <em>Wired</em>. "I always read the terms of service. . . . If you choose to be lazy and not go though that entire agreement or contract of agreement then absolutely you should be held liable." Lori Drew has clearly been convicted in the court of public (and jury) opinion &mdash; but does her case hold up when held to emotion-free scrutiny?</p>

			<title><![CDATA[MySpace Trial: Jury Is Close To A Verdict]]></title>

<p><img src="http://cache.gawker.com/assets/images/39/2008/11/thumb160x_loricourt112608.jpg" class="left image158" width="158" />Yesterday, at just before 5 p.m. Pacific time, the jury deciding <a class="autolink" title="Click here to read more posts tagged #loridrew" href="http://jezebel.com/tag/loridrew/">Lori Drew</a>'s fate <a href="http://www.latimes.com/news/local/valley/la-me-briefs26-2008nov26,0,2092676.story">emerged to announce</a> that it had reached a decision on 3 of the 4 counts against the Missouri mom, but were split on the fourth. According to the <em>LA Times</em>, Drew "is charged with three counts of violating federal computer statutes and one count of conspiracy," for creating the fake MySpace account she allegedly used to help torment her daughter's friend, 13-year-old <a class="autolink" title="Click here to read more posts tagged #meganmeier" href="http://jezebel.com/tag/meganmeier/">Megan Meier</a>. <em>Wired</em> notes that earlier in the day, the jury <a href="http://blog.wired.com/27bstroke6/2008/11/noverdict.html">asked</a> the judge "to clarify an earlier instruction related to the issue of a 'tortious' act &mdash; an act that causes malicious or negligent harm to, in this case, Megan Meier, which is a requirement for finding Drew guilty on the computer fraud charges."</p>

<p>Though the jurors did not indicate which charge they're hung up on, <em>Wired</em> also makes the point that three of the charges are nearly identical, so it's likely that the conspiracy charge is the one they're struggling with. In addition, "Jurors can find Drew guilty of conspiracy if they conclude that she schemed with others in violating MySpace's terms, without necessarily committing a computer crime herself." However, some detractors of Federal prosecutor Thomas O'Brien still believe that Lori Drew <a href="http://www.reason.com/news/show/130269.html">should not have been charged in the first place.</a> <em>Reason Magazine's</em> Jacob Sullum says:<br></p>
<blockquote>The charges did not fit the facts of the case…[O'Brien] never presented any evidence that Drew saw MySpace's Terms Of Service, let alone agreed to them. Furthermore, O'Brien's interpretation of the law would make criminals of us all. Shortly after the indictment, Orin Kerr, a George Washington University law professor who later volunteered as a pro bono attorney for Drew, noted, "Since everyone who uses computers violates dozens of different TOS every day, the theory would make everyone who uses computers a felon."</blockquote>
<p>The jury will reconvene at 9 a.m. to try to hash out that final charge and attempt to reach a unanimous verdict.</p>

			<title><![CDATA[MySpace Trial, Day 4: Sarah Drew Says Megan "Was My Best Friend" ]]></title>

<p><img src="http://cache.gawker.com/assets/images/39/2008/11/thumb160x_lorisarah112508.jpg" class="left image158" width="158" />Yesterday marked the final day of testimony in the trial of <a class="autolink" title="Click here to read more posts tagged #loridrew" href="http://jezebel.com/tag/loridrew/">Lori Drew</a>, which may set precedent in cases of cyberfraud and social networking. Today at 9 a.m. <a href="http://blog.wired.com/27bstroke6/2008/11/lori-drew-trial.html">a jury of six men and six women</a> will convene to decide the fate of Ms. Drew, whose online bullying of <a class="autolink" title="Click here to read more posts tagged #meganmeier" href="http://jezebel.com/tag/meganmeier/">Megan Meier</a> allegedly violated the MySpace terms of use and drove the 13-year-old to suicide. Judge George Wu says he will <em>not</em> decide whether or not <a href="http://blog.wired.com/27bstroke6/2008/11/judge-postpones.html">to dismiss the case</a> until after the jury has deliberated. In the final day of testimony, Lori's 16-year-old daughter, Sarah, took the stand to complete her testimony, more details came out about Megan's role in the initial rift with the Drew family, and both sides provided their closing arguments.</p>

<ul>
<li>Megan allegedly called Sarah an <a href="http://www.msnbc.msn.com/id/27894751/">"ugly lesbian,"</a> which is what prompted Lori Drew and her business assistant, <a class="autolink" title="Click here to read more posts tagged #ashleygrills" href="http://jezebel.com/tag/ashleygrills/">Ashley Grills</a>, to create the fake MySpace account in the first place.</li>
<li>According to <a href="http://www.people.com/people/article/0,,20242541,00.htm"><em>People</em></a>:<br>
<blockquote>Drew's now 16-year-old daughter Sarah testified Monday that, on Oct. 16, she was with Grills and, "I told her not to send that last message" to Megan that said that the world would be a better place without her.<br>
"Did Ashley send that last message?" O'Brien asked.<br>
"Yes," Drew said as she wept.<br>
Two of the six female jurors dabbed at their eyes.<br>
"She was my best friend," the defendant's daughter tearfully recalled.</blockquote>
</li>
<li>Defense attorney Dean Steward said in his closing statements that Drew can not be guilty of a conspiracy because a conspiracy implies intent. Drew didn't even read the MySpace terms of use, so she could not have intentionally violated them. "Nobody reads these things, nobody," he said. "... How can you violate something when you haven't even read it? End of case. The case is over."</li>
<li>More from Steward: "If you hadn't heard the indictment read to you, you'd think this was a homicide case…And it's not a homicide case. This, ladies and gentlemen, is a computer case, and that's what you need to decide."</li>
<li>In addition, he added that there was no cyberbullying in this case because "Megan dished it out the same way that she got it," and Steward also said, "[Ashley] Grills, bless her heart, is pathetic."</li>
<li>The prosecution focused on the tragedy of the case in order to sway jurors. According to the <em>AP</em>, "Lori Drew decided to humiliate a child," U.S. Attorney Thomas O'Brien said. "The only way she could harm this pretty little girl was with a computer. She chose to use a computer to hurt a little girl, and for four weeks she enjoyed it."</li>
<li>"The tragedy in this case is not just Megan Meier's suicide," U.S. Attorney Thomas O'Brien said in his closing arguments to jurors, <a href="http://www.reuters.com/article/lifestyleMolt/idUSTRE4AO0U020081125?"><em>Reuters</em> reports</a>. "It's the fact that it was so preventable. If, as a 47-year-old woman Lori Drew was so upset that Megan Meier had called her daughter ugly or a lesbian, she could have gone over and talked to her mom and we wouldn't be here."</li>

			<title><![CDATA[MySpace Trial, Day 3: Lori Drew's Daughter Speaks]]></title>

Sarah, now 16, <a href="http://usatoday.com/news/nation/2008-11-21-myspace-hoax_N.htm?imw=Y">testified</a> that Megan said to her, "I don't know if I could live anymore." (Sarah burst into tears when Federal attorney Thomas O'Brien asked her why she didn't tell anyone about Megan's confession of suicidal thoughts.) Much of what Sarah said under oath directly contradicted the testimony of her mom's assistant, <a class="autolink" title="Click here to read more posts tagged #ashleygrills" href="http://jezebel.com/tag/ashleygrills/">Ashley Grills</a>, on whom Lori Drew is placing most of the blame. Sarah claims that Lori told her assistant, <a href="http://jezebel.com/5095538/myspace-trial-day-2-lori-drew-says-its-not-like-i-pulled-the-trigger">Ashley Grills</a>, to delete the "Josh" profile at that time.</li>
<li>According to the <em>AP</em>, " Sarah also said she tried to stop Grills from sending the final message. 'I was like, Ashley, no, don't send it,' Sarah said. 'She said she sent it and laughed about it.'"</li>
<li>Sarah testified that she never saw her mother use the MySpace account, directly contradicting Grills.</li>
<li>Also from the <em>AP</em>:<br>
<blockquote>Sarah said Megan confided in her on two occasions that she wanted to kill herself. "She was like, I don't know if I could live anymore," she said of one instance. "I told her not to do it." Sarah cried on the witness stand and nodded when O'Brien questioned her about why she didn't tell any adults about the suicide conversations. Defense attorney Dean Steward stood up and lashed out at the region's top federal prosecutor for badgering the teenage girl.</blockquote>

<li>After the prosecution rested its case on Friday, <em>Wired</em> reports, <a href="http://blog.wired.com/27bstroke6/2008/11/lori-drew-pla-4.html">Drew's defense asked for an immediate dismissal</a> based on Sarah's testimony that Lori Drew never read or agreed to the MySpace terms of use, and as a result could not have violated these terms. Furthermore, Ashley Grills accepted these terms of use, not Lori Drew.</li>

<blockquote>Wu retired to his chambers to review transcripts of previous testimony and consider the motion. When he emerged 30 minutes later, he asked both sides to file written briefs on the issue. 			<title><![CDATA[MySpace Trial, Day 2: Lori Drew Says, "It's Not Like I Pulled The Trigger"]]></title>

<p><img src="http://cache.gawker.com/assets/images/39/2008/11/340x_myspacecase112108.jpg" class="left image340" width="340" />Yesterday was Day 2 of <a class="autolink" title="Click here to read more posts tagged #loridrew" href="http://jezebel.com/tag/loridrew/">Lori Drew</a>'s federal trial for cyberfraud in the tormenting of 13-year-old suicide victim <a class="autolink" title="Click here to read more posts tagged #meganmeier" href="http://jezebel.com/tag/meganmeier/">Megan Meier</a>. Day 1 focused on the <a href="http://jezebel.com/5094170/myspace-trial-day-1-megan-meiers-last-words">emotional testimony</a> of Megan's mom, Tina, who described her daughter's depression and last words. Day 2 involved Tina's cross examination by defense lawyer H. Dean Steward and the initial testimony of Drew's accomplice in Megan's tormenting, <a href="http://jezebel.com/375342/megan-meiers-myspace-hoax-tormenter-i-just-wanted-it-to-end">Ashley Grills</a>, who testified with government immunity. Lori Drew's hairdresser also took the stand, and her testimony about Drew's glee while mocking Megan was perhaps the most damning of all.</p>

<ul>
<li>When Lori Drew helped set up the fake MySpace account because Megan had allegedly been mean to her daughter Sarah, she <a href="http://blog.wired.com/27bstroke6/2008/11/lori-drew-pla-2.html">bragged</a> to her hairdresser Christina Chu about it. Chu was so upset over Drew's callousness she had to retreat to the back of the salon.</li>
<li>"After Meier's death, on the day of her wake, Drew showed up again to have her hair done. Chu asked Drew why she was going to the wake, given her role in the cyberbullying. Drew's response, Chu said, was, 'It's not like I pulled the trigger,'" <em>Wired</em> reports.</li>
<li>In his cross-examination of <a class="autolink" title="Click here to read more posts tagged #tinameier" href="http://jezebel.com/tag/tinameier/">Tina Meier</a>, Drew's lawyer <a href="http://blog.wired.com/27bstroke6/2008/11/lori-drew-pla-1.html">pummeled her</a> on Megan's past internet behavior. According to <em>Wired</em>, before the Meiers' started monitoring Megan's internet usage closely, "Megan created a MySpace profile as an 18-year-old woman, and swapped sexually-charged banter with other users, he said, citing notes he'd obtained from Megan's psychologist." The lawyer pointed out that Megan had also violated MySpace's terms of service at one point by lying about her age.</li>
<li>Drew's lawyer also pointed out that Megan was taking a trio of antidepressants when she died. "One of them, the antidepressant citalopram, has a reported side affect of contributing to suicidal behavior in children and adolescents suffering from depression, he noted."</li>
<li><a class="autolink" title="Click here to read more posts tagged #ashleygrills" href="http://jezebel.com/tag/ashleygrills/">Ashley Grills</a>, the then-18-year-old who was Lori Drew's assistant, said that the creation of the MySpace account was initially <a href="http://www.latimes.com/technology/la-me-myspace-trial21-2008nov21,0,7187265.story?">her idea</a>, but that Lori Drew agreed and "thought it was funny," the <em>L.A. Times</em> notes.</li>
<li>Grills said that Lori Drew was present when they agreed to the terms of service, but neither woman read them.</li>
<li>From the <em>L.A. Times</em>:<br>
<blockquote>Grills testified that she, Drew and Drew's daughter were trying to figure out a way "to expose Megan" for rumors she'd allegedly been spreading about Sarah…She said Drew also helped formulate messages that were sent to Megan and at one point suggested that they have 'Josh' arrange a meeting with Megan at a local mall at which Sarah and her friends would 'pop out' and tease Megan.</blockquote>
</li>
<li>This part also hurts the case of MySpace fraud against Drew: the final contact between Megan and "Josh" took place on AOL Instant Messenger, according to testimony by Grills.</li>
<li>Grills also testified that she had no idea that Megan had <a href="http://www.breitbart.com/article.php?id=D94J49N80&show_article=1">had emotional problems</a> in the past, until Drew told her shortly after Megan's death, "We could have pushed her overboard because she was suicidal and depressed.'"</li>
<li>When the Drew family and Grills got word that Megan had <a href="http://blog.wired.com/27bstroke6/2008/11/lori-drew-pla-3.html">killed herself,</a> they got off the internet and turned on the TV. Shortly thereafter, <em>Wired</em> reports, "Curt Drew started yelling at them to get rid of the MySpace account. When asked what Lori Drew did at that moment, Grills said at first she sat quietly and was consoling her daughter, then she, too, started yelling at them to delete the account and told them not to say anything to anyone."</li>

<p><img src="http://cache.gawker.com/assets/images/39/2008/11/thumb160x_meganmeier112008.jpg" class="left image158" width="158" />It's been a year since we <a href="http://jezebel.com/gossip/drew-no-blood/are-the-parents-who-myspace+tormented-megan-meier-into-killing-herself-ready-to-atone-um-323254.php">first wrote</a> about <a class="autolink" title="Click here to read more posts tagged #meganmeier" href="http://jezebel.com/tag/meganmeier/">Megan Meier</a>, the 13-year-old driven to suicide after being tormented on MySpace by a grown woman posing as a made-up boy named Josh Evans. The trial of that woman, 49-year-old <a class="autolink" title="Click here to read more posts tagged #loridrew" href="http://jezebel.com/tag/loridrew/">Lori Drew</a>, began yesterday. Drew is being prosecuted in federal court for cyberfraud under a <a href="http://jezebel.com/342469/feds-take-on-megan-meier-case-hope-to-charge-evil-mom-with-crime">2005 telecommunications law.</a> The details of the first, highly emotional, day in court are after the jump, including heartbreaking testimony from Megan's mom, Megan's last words, and the prosecution's assertion that Lori "fully intended to hurt" Megan.</p>

<li>In his <a href="http://www.cbsnews.com/stories/2008/11/20/tech/main4619671.shtml?">opening statement</a>, prosecuting U.S. Attorney Thomas O'Brien said that Lori Drew created the fake persona of Josh Evans to find out whether Megan was spreading rumors about Drew's daughter, Sarah, <em>CBS News</em> reports.</li>
<li>O'Brien says Drew "fully intended to hurt and prey on Megan's psyche," and added thatshe "hatched a plot to prey on the psyche" of a 13-year-old she knew was "vulnerable, suicidal and boy crazy."</li>
<li>"One of her plans was to print out the conversations and take it to Megan's school and let people make fun of this depressed 13-year-old girl," O'Brien <a href="http://www.latimes.com/news/local/la-me-myspace-trial20-2008nov20,0,852085.story">also said.</a></li>
<li>Megan's mom, <a class="autolink" title="Click here to read more posts tagged #tinameier" href="http://jezebel.com/tag/tinameier/">Tina Meier</a> took the stand. Reports <em>CBS</em>:<br>
<blockquote>Meier said after a name-calling exchange between Megan, "Josh," and two other girls in October 2006, she told a sobbing Megan, who was being treated for attention deficit disorder and depression, that she wasn't supposed to be online and shouldn't have gotten into the argument. "The last words she said to me were 'You are supposed to be my mom, you are supposed to be on my side,"' Meier said as she tried to hold back tears.</blockquote>

<li>According to the <em>L.A. Times</em> this was the final exchange between "Josh" and Megan. Josh: "The world would be a better place without you. Have a shitty rest of your life." Megan: "You are the kind of boy a girl would kill herself over."</li>
<li>Lori Drew's attorney <a href="http://www.reuters.com/article/topNews/idUSTRE4AJ14O20081120?">claims</a> she "shut down the profile when she learned that Meier was becoming romantically interested and hinting that she wanted to meet Josh Evans," <em>Reuters</em> reports.</li>
<li>Lori has pleaded not guilty to "one count of conspiracy and three counts of accessing computers without authorization. Each count carries a potential sentence of five years in prison," says <em>CBS News</em>.</li>
<li>From the <em>L.A. Times</em>: "Lori Drew, dressed in a sweater and looking every bit the Midwestern mom, sat expressionless at the defense table during much of the proceedings."</li>

"I don't necessarily think the suicide is relevant to the crime charged," <a class="autolink" title="Click here to read more posts tagged #judgegeorgehwu" href="http://jezebel.com/tag/judgegeorgehwu/">Judge George H. Wu</a> says. He thinks details of Meier's death would "unfairly prejudice the jury."</p>

<p>Lori Drew is accused of using a fictitious profile on MySpace to drive <a class="autolink" title="Click here to read more posts tagged #meganmeier" href="http://jezebel.com/tag/meganmeier/">Megan Meier</a>, her daughter's former friend, to hang herself. She's pleaded not guilty to one count of conspiracy and three counts of accessing computers without authorization. She's being charged under the Computer Fraud and Abuse Act, which is usually used for hackers and high-tech crimes. But this Act has <em>never</em> been used in connection with a Web site's "terms of service" agreement.</p>
<p>Still, the most terrible part about this case is the fact that a 49-year-old woman tormented a 13-year-old girl to the point that the child <em>took her own life</em>. If the jury doesn't hear about the suicide, does the prosecution have a chance of winning?</p>

The <a href="http://www.reason.com/blog/show/127960.html">Electronic Freedom Foundation has filed an <em>amicus</em> brief</a> in her case agreeing with <a href="http://jezebel.com/5028646/">her lawyers' assertions</a> that the daily violation of websites Terms of Service agreements either makes us all a national of criminally liable liars, or no one (including Lori Drew) is. I mean, the difference is that when I violate a TOS agreement, I'm not doing it to torment a teenage girl to the brink of suicide. Unfortunately, their logic is pretty convincing, so we're guessing she'll get away with it after all (minus a few lawyers' bills). Lucky us. Times</em>. (For those of you who missed our exhaustive Meier coverage, Drew and an 18-year-old accomplice created a fake MySpace profile for a "Josh Evans" to torment Megan because of some slight towards Drew's daughter. After being rejected by Josh, Megan, who had a history of emotional problems, hung herself.) According to the <em>Wall Street Journal</em>, "The theory of the case seems to be that when Drew registered on MySpace she agreed to certain terms of service that required her to, among other things, provide 'truthful and accurate registration information' and 'refrain from promoting information that' she knew was<br>
'false or misleading.'"</p>

<p>Drew is being charged with violating federal statute as outlined in the <a href="http://www.law.cornell.edu/uscode/html/uscode18/usc_sec_18_00001030--&mdash;000-.html">Computer Fraud and Abuse Act</a>, but this is the first time the Act has been used in a social networking scenario. USC law professor Rebecca Lonergan tells the <em>L.A. Times</em>, "It's a very creative, aggressive use of the statute. But they may have a legally tough time meeting the elements." Another California attorney, James Chadwick, thinks the state will have a tough time convicting Lori Drew on these grounds. "As tragic as it is," Chadwick said, "You can't start imposing liability on people for being cruel."</p>
<p>If Lori Drew is convicted she faces four counts, each of which carry a five year maximum jail sentence. The trial is set for July 29. Even if the case is a wash, the public shaming of Lori Drew has at least one positive outcome, the <em>LAT</em> reports. "In response to the case, Missouri legislators gave final approval to a bill making cyber harassment illegal."</p>

But whatever, we are generally satisfied. Lori Drew, who created a fake MySpace profile for a 16-year-old named "Josh Evans" and used it to fuck with Megan in retaliation for ending her friendship with her daughter, has yet to speak up for herself, but every time we think, "Just leave her alone already," <a href="http://jezebel.com/375342/megan-meiers-myspace-hoax-tormenter-i-just-wanted-it-to-end">someone else speaks out with another testimonial to her shittiness.</a> Today we learn a little more about "Josh"'s flirting technique.</p>

Here Ashley admits she writes the message that drove Megan to hang herself, but says she did it because she knew the joke had gone too far and wanted to erase the account. And why did she think it had gone too far? 			<title><![CDATA["90 Day Jane" Refuses To Justify Her Enormous Internet Joke]]></title>

<p><img src="http://jezebel.com/assets/resources/2008/02/90dayjane22508.jpg" class="left image158" width="158" />The story of 90DayJane, like the <a href="http://jezebel.com/346256/doth-not-a-mentally+ill-popstar-bleed">Britney period shots</a>, is supposed to illustrate the seedy, soulless depths of the aughts' virtual culture. For those not familiar with it, on February 5, "90dayjane," a twenty-something pretty brunette resident of Los Angeles, put up a website on which she claimed she would off herself in 90 days. "This blog is not a cry for help," said Jane. "I'm not depressed and nothing extremely horrible has lead me to this decision. But, does it really have to?" Her site, naturally, became a <a href="http://latimesblogs.latimes.com/webscout/2008/02/from-the-sunday.html">sensation</a>. Hundreds of thousands read it, and their comments, like those found within any other unregulated corner of the internet, were mostly appalling. "Post nudes first," one commenter advised. Then last week, the person behind 90 Day Jane killed the site &mdash; not herself &mdash; and told the world that the website had been a hoax &mdash; a "personal art piece" and that "It was meant for me and (what I ignorantly thought would be) a small number of people."</p>

<p>The site, of course, is no longer available, but, in an email to <em>Los Angeles Times</em> writer <a class="autolink" title="Click here to read more posts tagged #davidsarno" href="http://jezebel.com/tag/davidsarno/">David Sarno</a>, the elusive Jane, who is choosing to remain anonymous, explains her project thusly: " I attempted to create something as an artist, public perception changed that creation and so I killed it before it got out of hand. In my opinion it became much more interesting as a social experiment, but I couldn't fool myself into justifying it in that way; I'm not a sociologist."</p>
<p>And she shouldn't have been able to justify it, because the fact is that, art project or not, creating that site was a pretty shitty thing to do. As Sarno points out, "There is a kind of Internet suicide culture. Not of kids pretending they're going to kill themselves but for sometimes extremely depressed people who have nowhere else to go to get support. Not to mention meeting places for bereaved friends and families of suicides." Or maybe Jane should have asked <a href="http://jezebel.com/gossip/drew-no-blood/are-the-parents-who-myspace+tormented-megan-meier-into-killing-herself-ready-to-atone-um-323254.php">Megan Meier's parents</a> how they felt about it. Or possibly the many teens who committed suicide <a href="http://jezebel.com/348148/seven-kids-hang-themselves-in-the-name-of-networking">using the social network bebo.</a></p>
<p>Ultimately, the site was just a manipulative game that spun out of control. "People don't get to choose how the public perceives them and they can spend a lot of time and money trying to change that perception," Jane wrote to Sarno. "By keeping my identity away from 90DayJane, I get to skip all of that." And this is why the 90DayJane stunt is an allegory for internet culture as a whole: the most vile shades of human nature are in evidence on the internet because they're allowed to remain anonymous.</p>

			<title><![CDATA[Susan Faludi: Hillary Is Hated Not Because She's a Woman, But Because She's A Mother]]></title>

<p><img src="http://jezebel.com/assets/resources/2008/01/hillary13008.jpg" class="left image158" width="158" />Manhattan broadsheet the <em>New York Observer</em> scored quite the coup this week, signing up author Susan Faludi to take on the controversial new anthology about <a class="autolink" title="Click here to read more posts tagged #hillaryclinton" href="http://jezebel.com/tag/hillaryclinton/">Hillary Clinton</a> <a href="http://www.observer.com/2008/hillary-and-feminine-gaze-close-and-personal"><em>Thirty Ways of Looking at Hillary: Reflections By Women Writers</em></a>. Derided by <a href="http://jezebel.com/350194/30-women-hate-on-hillary-in-30-different-waysl">other critics</a> as narcissistic (among other things), the book is not one of Faludi's favorites either: the feminist pundit describes it as "a good deal of convenient psychologizing, self-absorbed meanderings and unearned snipes" and all but calls it sexist, asking readers to imagine its conceit applied to <em>male</em> writers and a <em>male</em> presidential candidate: "Inside, we would find ruminations on the male candidate's doggy looks and flabby pectorals; musings on such 'revealing' traits as the candidate's lack of interest in backyard grilling, industrial arts and pets... We would hear a great deal about how the candidate made them feel about themselves as men and whether they could see their manhood reflected in the politician's testosterone displays. ... And we would hear virtually nothing about the candidate's stand on political issues."</p>

<p>With that out of the way, Faludi focuses in on <em>why</em>people hate Hillary so much, pointing to a culture in which only younger women are prized and writing that once women's "30-years-old freshness date has expired... [they] are out of luck &mdash; there's no matriarchy to step in to offer wisdom and hand over the reins." She also argues that Clinton, because of her age and her potency, gets associated with "mother" in a primal way, and that the country's penis-obsessed Portnoys subconsciously regard her as "the smothering, devouring American Mom whose power male writers have been shuddering under since at least the 1950's."</p>
<blockquote>For all the hosannas over young women advancing in competitive sports or Katie Couric snagging the <em>CBS News</em> anchor slot, we continue to have no tradition and no real image of public female authority. As [<em>Vanity Fair</em> writer Leslie] Bennetts observes in her essay, 'A woman can become Speaker of the House, but Nancy Pelosi has to cloak her authority in gender mufti by describing her ability to order congressmen around as using her 'mother-of-five voice.' A female can't just be strong and forceful and direct in her decision making; she has to revert to being a mom, which we all know is her primary role anyway.'</blockquote>
Is that really the problem? Are Americans working out their mommy issues in the polling booths instead of the therapist's office? Or is Faludi just participating in some theoretical mental masturbation in the name of taking the piss out of the patriarchy? Hell if I know, but I'm definitely sick of talking about Hillary and "feelings". Maybe brilliant American essayists like Katha Pollitt and Dahlia Lithwick can start talking about Hillary's <em>policies</em> instead, and soon.

Because there's been a spate of hangings in Brigend Wales. It starts with Dale Crole, a 20-year-old straight from juvi who hanged himself in a warehouse and was found a year ago. A friend of Dale's named David hung himself next, and a friend of David's went next, and four more boys followed before last Thursday, when 17-year-old Natsha Randall hung herself in her family basement. Now cops seem to be wondering whether Randall spearheaded some sort of vapid suicide cult. It's hard to say. All the members of the suicide ring had heavy internet habits. A <a href="http://www.dailymail.co.uk/pages/live/articles/news/news.html?in_article_id=509804&in_page_id=1766&in_page_id=1766&expand=true#StartComments">story</a> about Natasha "sxiwildchild"'s page on the social networking site bebo in the <em>Daily Mail</em> portrays her as one of those teenagers whose inability to distinguish right from wrong seems palpably traceable to an inability to distinguish real life from the internet. (The story notes that "Will you have sex with me?" is the fourth question she asks prospective friends on the site.</p>

<p>And while I'm reluctant to accept the <em>Daily Mail</em>'s theories about the character or motivations of pretty much anyone with a vagina, it seems disturbingly clear that the problem here is not so much the "glorification of suicide" &mdash; which, let's face it, is old as time or at least def. Shakespeare &mdash; but the fact that, for the younger generation, the fanatical posing and uploading and friend-collecting and pixelated mirror-staring enabled by Internet "networking" can stunt a kids' development at the age and maturity level at which they first discovered started logging on. As one of the dead kids' moms pointed out:</p>
<blockquote>I think the problem is they do not know how to speak like adults about serious issues like this. They can speak to each other on the computer but do not know how to express their emotions in other ways.</blockquote>
And the inability to <em>express</em> their emotions begets, in a way, an inability to feel them.
<p>Yeah, I know, I'm fucking old. Which is why I'm going to just say it: can't we fucking BAN MYSPACE, and all its bastard social networking stepchildren, already? What redeeming social value do these sites have?<br>
Pastimes like this make Halo look like the fucking Model U.N.</p>

			<title><![CDATA[Girl-On-Girl Crime: Schools Step In]]></title>

<p><img src="http://jezebel.com/assets/resources/2008/01/meangirls012108.jpg" class="left image158" width="158" />As anyone can tell you, there are few things as dangerous &mdash; or terrifying &mdash; as a roving pack of 13 year old girls. The <em>Guardian</em> reports that teachers in the UK are being instructed to <a href="http://observer.guardian.co.uk/uk_news/story/0,,2243671,00.html?gusrc=rss&feed=society">crack down on vicious and manipulative behavior</a>. According to Vicky Tuck, head of Cheltenham Ladies' College, girls of 12 and 13 years old "move in and out of friendships quite a lot." She notes, "They can be a bit mean, isolate somebody one day and not the next." Jade Prest, now 17 years old, survived a "sustained campaign of girl-on-girl bullying" when she was 15. She received a barrage of threatening text messages, had rumors about her spread on the internet, and started cutting herself before she eventually attempted suicide. "One girl started it all," she says. "Because of one person, no one talked to me. I became depressed and put myself into isolation."</p>

Explains Val Besag, an educational psychologist who's written a book, <em>Challenging Girls</em>, "Boys have a hierarchy based on physical power, girls have a hierarchy based on friendships." Ms. Besag recommends that teenagers watch <a class="autolink" title="Click here to read more posts tagged #meangirls" href="http://jezebel.com/tag/meangirls/">Mean Girls</a> to show how detrimental manipulation and backstabbing are. Ms. Tuck warns that bitchy behavior is "women's last barrier to triumph in the workplace."</p>
<p>On one hand, emotional abuse from bullying can mean tragedy for young women like Jade Prest &mdash; and <a class="autolink" title="Click here to read more posts tagged #meganmeier" href="http://jezebel.com/tag/meganmeier/">Megan Meier</a>. But can schools really have an impact? And truthfully, as bad as it gets, bullying (or being bullied) can be a time-tested rite of passage for many girls. And when you're 13 years old and being bullied by a group of other girls, isn't it possible that the interference of an adult will just make the situation worse?</p>

			<title><![CDATA[Teen Rape, MySpace & Child Protection Laws]]></title>

<p><img src="http://jezebel.com/assets/resources/2008/01/hardcandy11508.jpg" class="left image340" width="340" /> Two married strippers, <a class="autolink" title="Click here to read more posts tagged #juliorojas" href="http://jezebel.com/tag/juliorojas/">Julio Rojas</a>, 31, and <a class="autolink" title="Click here to read more posts tagged #sophiesoto" href="http://jezebel.com/tag/sophiesoto/">Sophie Soto</a>, 22, were <a href="http://www.nypost.com/seven/01152008/news/regionalnews/stripper_duo_raped_girls_531057.htm">charged</a> yesterday with 56 counts of sex abuse for luring a pair of under 15-year-old girls to their Queens apartment through MySpace. Soto acted as the bait, convincing one girl that she was 18 and had only been with girls before, according to the <em>New York Post</em>. She told the teen that she was scared to have sex with a man. Through a feat of persuasion not outlined in the article, Soto convinced the teen and her friend to send 20 close ups of their vaginas. When Soto finally got the girls to her apartment, she had sex with both of them, after which husband Julio had sex with all three women. After they were done, Soto and Rojas took the girls to a strip club, where the underagers stripped on stage and gave bjs to customers. The most fucked up part? For all of these disturbing, horrific transgressions, the couple faces 15 years in jail, tops. They need some <a href="%20http://www.imdb.com/title/tt0424136/"><em>Hard Candy</em></a> style vigilante justice on their asses, dontcha think?</p>

<p>As the Soto and Rojas case was in court, MySpace announced <a href="http://www.nytimes.com/2008/01/15/us/15myspace.html">new measures</a> to help police sexual predators on the site. The company worked with attorney generals from several states to draft their agreement, which, according to the <em>New York Times</em> includes, "separat[ing] children's profiles from those of adults and seek[ing] ways to verify users' ages." They plan to create a "task force" to help police the site, but as Connecticut attorney general Richard Blumenthal told the <em>Times</em>, "No measure is a panacea."</p>
<p>The important thing, it seems to me, about this new law is that it might be setting a precedent that ultimately helps <a href="http://jezebel.com/342469/feds-take-on-megan-meier-case-hope-to-charge-evil-mom-with-crime">the family</a> of <a href="http://jezebel.com/344538/megan-meier-just-your-average-small-dog+loving-depressed-bipolar-add-suburban-babi">poor Megan Meier.</a> The <em>Times</em> says that MySpace's agreement is built on an earlier Facebook agreement with the feds, both of which acknowledge that the companies "[bear] responsibility for protecting users." <a class="autolink" title="Click here to read more posts tagged #loridrew" href="http://jezebel.com/tag/loridrew/">Lori Drew</a>, Megan's adult MySpace tormentor, might not ultimately get comeuppance, but perhaps the Meiers can still sue the fuck out of MySpace for not doing more. Isn't MySpace culpable in these situations? Or is it just the risk we all take in a world with evil people and Internet access?</p>

			<title><![CDATA[Megan Meier: Just Your Average, Small Dog-Loving, Depressed, Bipolar, A.D.D. Suburban Babi]]></title>

<p><img src="http://jezebel.com/assets/resources/2008/01/071206_meier_hmed_1p.widec.jpg" class="left image158" width="158" />The <em>New Yorker</em> becomes the latest media outlet to reexamine the <a class="autolink" title="Click here to read more posts tagged #meganmeier" href="http://jezebel.com/tag/meganmeier/">Megan Meier</a> suicide this week, and despite this topic not exactly being underexposed, it's a thoughtful, texture-rich story about a girl who sounds so insanely <em>normal</em> you sorta wonder how the fuck you would go about raising <em>yourself</em> as a teenager. (Ooooh, answer: stealing your kids' mood-altering meds, duh.) Not innately insecure/nerdy/un-self-confident, Megan was a daddy's-little-tomboy (she fished, threw frogs, etc.) who had a sassy attitude tempered by a very kind streak &mdash; "for years she had served as the self-appointed guardian of a blind boy at her school, leading him through the hallways between classes." But her angst over her chunky legs began in kindergarten, and by middle school she was taking Celexa, Concerta and Geodon (a bipolar disorder drug.)</p>

<p>Parents Tina and Ron, who met in second grade and married just out of high school, come across as unimpeachably sympathetic as ever; they reared Megan in a friendly subdivision free of laundry poles and aboveground pools and when she seemed to be striving for the "instant maturity look" too early, they enrolled her in a Catholic school where she wore a uniform and stopped "paying attention to her hair as much" and "worrying about undereye concealer." Then came Josh Evans...</p>
<blockquote>Playing on Megan's susceptibility to underdogs, Josh's creators endowed him with a pitiable bio: "when I was 7 my dad left me and my mom and my older brother and my newborn brother...poor mom yeah she had such a hard time...finding work to pay for us after he left." His ambitions also seemed tweaked to Megan's desires. His answer to the section "Goal you would like to achieve this year" was "meet a great girl." The girl he was looking for happened to have long brown hair, like Megan. As for weight, Josh answered, "DON'T REALLY MATTER."</blockquote>

And this of MySpace, where Megan's handle was "Megan Babi", as Times Square circa 1977:

You may learn things you didn't know: The Meiers and the Drews were once friends and the Drews took Megan on vacation; they were aware she took medication for depression.
